Please be informed that on or about 10:30 P.M. of April 22, 2011 joint elements of this Office led by the undersigned and Rizal Provincial Police Office conducted police operation at Sitio Sanakai, Brgy. Dela Paz, Antipolo City resulting in the arrest of ARMANDO CARIÑO y OBIAS, 52 yrs old, married, DOB: May 7, 1958/POB: Camarines Sur, and resident of Agora Complex, Sto. Niño, Marikina. It will be recalled that said arrested person is the alleged gunman who shot and killed BIR Revenue District Officer Marcelino Yap on Feb. 17, 2011 along Marcos Highway, Brgy. Mayamot, Antipolo City. A case of Murder was filed against the suspect before the Antipolo City Prosecution Office on Feb. 19, 2011 docketed under I.S. No. XV-01-INQ-11B-00134.
Investigation disclosed that sometime in the last week of February 2011, this Office was able to track down the suspect’s whereabouts at Paliparan III, Dasmariñas, Cavite, but could not make an arrest due to lack of legal basis at the time. Instead, the suspect was constantly trailed, firstly, in order to monitor his activities and possibly establish new discoveries as to the identities of his co-principals in the crime, and secondly, to keep track of his whereabouts so that we can readily locate him in the event that a warrant of arrest is issued against him. Because said ARMANDO CARIÑO traveled from one place to another, the scope of surveillance and stake out operations extended as far as Las Piñas City, Marikina City, Manila, Quezon City, Rizal Province, and other places in Cavite province, during which time best efforts were exerted to keep the operations discreet.
On the date/time/place of arrest, however, while the arresting team was hot on the suspect’s trail, he somehow sensed that he was being followed and suddenly pulled out a cal. 45 pistol and pointed the same to the direction of SPO2 Demetrio S. Magpali of Rizal PPO and PO3 Cornelio G. Berania of this Office, prompting the said police officers to draw their respective service firearms and introduce themselves as police officers, while the rest of the team rushed in to join, with drawn guns all pointed at the suspect. Disadvantaged in both number and firepower, the respondent succumbed and decided to surrender peacefully.
When inspected, the respondent could not present any license or permit for his weapon, hence, he was immediately placed under arrest after being informed of his constitutional rights and the nature of offense being imputed against him in a language that he knows and understands. When bodily searched for other deadly weapon, he yielded a hand grenade from the left front pocket of his khaki pants. Thereafter, the apprehended person and confiscated pieces of evidence were immediately brought to this office for booking, documentation, and proper disposition.
This Office is preparing a case of violation of P.D. 1866 (Illegal Possession of Firearms and Ammunition) as amended by R.A. 9516 (Stiffer Penalties for Illegal Possession of Explosives) against the suspect to be filed before the Antipolo City Prosecution Office, Antipolo City. //
